I'm sure others have seen this but thought it was an interesting topic of discussion. It appears Tom Petty is taking a closer look (http://news.webindia123.com/news/articles/Entertainment/20060602/351707.html) at Dani California regarding claims that the song contains a curiously riff to Mary Janes Last Dance.
A mix up is attached and the Chili's vid of Dani California can be seen here (http://www.youtube.com/watch?v=YUYuNqc0T_g&search=California)
That seems kind of bogus to me. Lots of songs have the same chord progression. The actual sound of the songs is not alike, especially at the chorus.

this seems like a HUGE stretch--when petty's lyrics are put over the chili peppers instrumentation, it sounds like his verse has been sped up considerably. granted, they sound kind of cool together and are complimentary, but the choruses are nothing alike and although they may have a few of the same chords, it's like saying that dave ripped off kelly clarkson because they both have songs with a C or D chord in them.

The rythyms are both very close, but I do not think Chili Peppers ripped off the song. They have been at this for a long time and they know better. It is kind of like when PJ got accused of using Zep's "Going to California" riff in "Given to Fly" They may kind of sound the same, but a lot of songs do,

Yeah this has been my take...I mean we are talking about chords. It's not like the time Smashing Pumpkins were pissed that Collective soul basically stole the whole guitar arrangement from Drown. Corgan openly lashed out at lollapalooza at the Saratoga Raceway by inserting Collectives' "Shine" lyrics into Drown before playing the fav. Collective Soul blows IMO, but hell they sold a lot of records so they must be somebody's thing:thumbsup:.

Yes, they sound very similar.. damn close in fact, but I really don't think there is anything intentional there.. RHCP are a talented group, they don't need to rip off Tom Petty...

Yeah, The Chili Peppers have always been a very original band, they don't need to be ripping off Tom Petty. It's just laughable really!!

does anyone know copyright law as it pertains to music? i mean, covers of songs are allowed, even incorporating pieces of songs into your own original songs are kosher (think the "stop, listen what's that sound?" by CSN in DMB). am i correct in thinking that 1) you can't plagerize someone else's lyrics and call it your own and 2) you can't plagerize the music, add different lyrics and call it your own? is that pretty much all musicians have as far as copyright is concerned?
